Terms of sale

Standard terms

These are our general terms. The terms published with each individual auction take precedence over anything on this page.

Registration and bidding

Bidding requires a registered bidder account. Registration is free. Registering for one sale does not carry over to another, so you must register for each auction you intend to bid in.

By placing a bid you enter a binding commitment to purchase that lot at your bid price if you are the successful bidder. Bids cannot be retracted once placed.

We reserve the right to refuse or cancel any registration, and to reject any bid, at our discretion.

Condition of lots

All items sell as-is, where-is, with all faults, and without warranty of any kind, express or implied.

Descriptions and photographs are provided in good faith as a guide only. They are not a warranty or representation of condition, age, authenticity, provenance or fitness for any purpose. Buyers are responsible for satisfying themselves as to the condition of any lot before bidding, whether by inspection at preview or by asking questions in advance.

No sale is voided, and no refund is issued, on the basis that an item differs from a buyer's expectation.

Payment

Removal and pickup

Buyers are responsible for the removal, loading and transport of all purchased items. Staff cannot load items for you, and equipment is not provided.

Pickup takes place at the location stated for that sale, within the published pickup window. Book a pickup slot rather than arriving unannounced.

Shipping

Shipping is not offered as standard and varies by sale. Where shipping is available for a particular auction, it is stated in that auction's terms. If shipping is essential for you, confirm availability before bidding rather than after.

Real estate

Real property sells subject to the terms stated in the sale bill for that property. Those terms govern and take precedence over this page.

Each real estate sale bill states whether the sale is absolute or subject to seller confirmation, the deposit required on the day of sale, the settlement window, and any conditions of sale.

Firearms

Firearms are sold and transferred in accordance with all applicable federal and Pennsylvania law. Buyers are responsible for ensuring they are legally eligible to purchase and receive a firearm before bidding.

Default

A buyer who fails to pay or fails to remove purchased items within the stated window may have their bidding privileges suspended, and we reserve all remedies available to us.

Disputes

Our record of the sale is definitive. In the event of a dispute over a bid, we reserve the right to reopen bidding on the lot or to determine the successful bidder at our discretion.

Licensing

John Carl Auction Company holds Pennsylvania auctioneer license AY002149.

Question about a specific sale?

The terms published with each auction govern that sale. If something is unclear, ask before you bid rather than after.
